MINUTES OF CITY COUNCIL PROCEEDINGS
MENNO, SOUTH DAKOTA
Mayor Larry Tolzin called the city council to order at 7:30 p.m. on October 2, 2006 in the council room at city hall. Council present: Dennis Aisenbrey, Galen Guthmiller, Gary Herman, John Huber, Jerome Kotalik, and Darrell Mehlhaf, Finance Officer Peggy Thranum, City Attorney Kenneth D. Bertsch and Superintendent Fred Sayler. Erik Kaufman, Ken Stepanek, Christian Sorlien, Aaron Matthaei, and Terry Hora were also present.
Huber moved to approve the agenda, Herman seconded, all present in favor; motion carried.
REGULAR MEETING ITEMS: Guthmiller made a motion to approve the minutes of the September 7 regular meeting. Aisenbrey seconded; all present in favor; motion carried.
Herman moved to approve the September finance report. Huber seconded, all present in favor; motion carried.

Kotalik made a motion to approve the warrants as presented. Huber seconded, all present in favor; motion carried.

RESOLUTION
FENCE EXEMPTION
Councilman Dennis Aisenbrey introduced the following resolution and moved for its adoption:
WHEREAS Christian Sorlien has requested an exception from the fence ordinance, Chapter 13 of the 2005 REVISED ORDINANCES OF THE CITY OF MENNO, SOUTH DAKOTA, so that he can use sheet metal to construct a fence of eight (8) feet or less in height in the front yard of the property where the business of Sorlien Welding & Mfg is carried on, such property being located at 158 W. Poplar, in Menno, SD, and being described as:
Lots Four (4) and Five (5), of Block Three (3), of the Original Plat of the City of Menno, Hutchinson County, South Dakota.
NOW THEREFORE BE IT RESOLVED, that
Christian Sorlien shall be granted an exception from Chapter 13 of the 2005 REVISED ORDINANCES OF THE CITY OF MENNO, SOUTH DAKOTA, only to the extent that he may:
1. Construct a fence of eight (8) feet or less in height in the front yard of the property where the business of Sorlien Welding & Mfg is carried on, such property being located at 158 W. Poplar, in Menno, SD, and being described as:
Lots Four (4) and Five (5), of Block Three (3), of the Original Plat of the City of Menno, Hutchinson County, South Dakota.
2. Such fence may be constructed of new sheet metal.
This exception is granted on the condition that:
A. The most visibly pleasing side of the fence shall be facing Poplar Street; and
B. All other requirements set forth in Sections 13-1 to 13-4 inclusive, of the 2005 REVISED ORDINANCES OF THE CITY OF MENNO, SOUTH DAKOTA shall be followed.
Councilman Gary Herman seconded the motion, and after full and complete discussion, the resolution was unanimously adopted on roll call vote.

OLD BUSINESS: “To Do List”: Sayler reported they are trimming trees that hang over the street.
Mehlhaf reported they are writing specifications to let bids for the repairs that need to be done at the pool, but they aren’t ready yet.
NEW BUSINESS: Following a lengthy discussion, Aisenbrey made a motion to table the first reading of the “Dog-Cat Tag-Vaccination Ordinance to the November meeting. Guthmiller seconded, all present in favor; motion carried.
Huber made a motion to pay expenses for Sayler and Heckenlaible to attend a wastewater workshop in Yankton on October 26, 2006. Mehlhaf seconded, all present in favor; motion carried.
Mehlhaf made a motion to pay expenses for someone to attend the Housing Conference in Pierre November 14-15. Herman seconded, all present in favor; motion carried.
Aisenbrey made a motion not to hire an extra restricted use site worker at this time as we already have two part-time employees that can fill in when needed. Huber seconded, all present in favor; motion carried.
Mehlhaf made a motion to keep the restricted use site open one night per week until one-half hour after sunset during the fall; the night to be set by the RU Site manager. A notice will be published in the paper as to the day. Huber seconded, all present in favor; motion carried.
Herman made a motion to approve signing a Basic Life Support / Advanced Life Support Agreement between the Menno Ambulance Service and Yankton County Emergency Medical Services and having Ambulance Director Marsha Schelske sign it. Aisenbrey seconded, all present in favor; motion carried.
Aisenbrey made a motion to purchase a copier from Western Office Plus in Yankton. Guthmiller seconded, all present in favor; motion carried.
Guthmiller made a motion to accept the resignation of Twilah Stirling from the Experience Works program due to health reasons. Huber seconded, all present in favor; motion carried.
Kotalik made a motion to pay Harold Vis $10 per hour for trimming trees. Guthmiller seconded, all present in favor; motion carried.
FOR YOUR INFORMATION: The packet from the September 19 MADC meeting and the SEFP report were included in the council packets.
A packet containing public information from the Office of the Secretary of State concerning constitutional amendments, initiatives and referred measures was given to the council.
The City received notice from Mediacom that they are dropping programs as follows as of November 6, 2006: In Demand PPV 8 on channel 508 and In Demand PPV 9 on channel 509. Customers are being notified by a bill message.
Aisenbrey made a motion to adjourn at 8:15 p.m. until Monday, November 6, 2006 at 7:30 p.m. Huber seconded, all present in favor; motion carried.
