Mayor Larry Tolzin called the city council to order at 7:30 p.m. on December 3, = 2007 in the council room at city hall. Council present: Dennis Aisenbrey, Galen Guthmiller, Gary Herman, John Huber, Jerome Kotalik and Darrell Mehlhaf, Finance Officer Peggy Thranum, Superintendent Fred Sayler and City Attorney Ken Bertsch. Ray Woehl, Aaron Matthaei, Erik Kaufman, and Randy Woehl were also present.

Huber = moved to approve the agenda with the following corrections: Delete DSG-Water Met= ers and Add IS300 & IS400 Classes. Guthmiller seconded, all present in fav= or; motion carried.

REGULAR MEETING ITEMS: Herman moved to approve the minutes of the November 5 regular meeting. Kotalik seconded, a= ll present in favor; motion carried.

Guthmiller made a = motion to approve the November finance report. Aisenbrey seconded, all present in favor; motion carried.

The gentlemen from Dakota Supply Group who were going to talk to us about water meters could not make tonight’s meeting. They have been re-scheduled= for January 7, 2008.

OLD BUSINESS: “To Do List”: The Christmas lights look good, but the banner that hangs across the street needs to hav= e the lights checked; they light on the east side only.

Mehlhaf spoke with Delano and Larry Klaudt of Klaudt Serv= ice. They don’t feel there is a problem with the way the truck route was set u= p. No changes will be made to the truck route at this time.

Funding is limited as to what can be done at the pool. Mehlhaf made a motion to advertise for pool bathhouse repairs in two bids: 1) For the removal and replacement of the cement floor, new plumbing and new fixtures (toilets, s= inks and showers) in the pool bathhouse 2) Repair of the cement walls of the bathhouse (tuck pointing and stuccoing). Bids will be advertised as soon as they are written and presented at the February council meeting. The finish= date will be before Memorial Day 2008. Huber seconded, all present in favor; mo= tion carried.

Ray Woehl addressed the council concerning his properties. Following discussion, Mehlhaf made a motion to allow Ray Woehl to tear down his buildings and clean= up the lots at 220, 222 and = 224 S Fifth Street or transfer title of the propert= ies to another owner by June 1, 2008. If this has not been done, the city may ent= er and clean up the property and assess the cost of the clean up against the property. Guthmiller seconded, all present in favor; motion carried. Ray W= oehl agreed to these terms.

Mehlhaf made a motion to allow Ray Woehl to have until January 1, 2008 (dependent upon the weath= er) to clean up the property at his residence at 129 and 131 N Pearl Street. Guthmiller sec= onded, all present in favor; motion carried.

Huber made a motion to declare the property at 201 S East Street a nuisance. The property owner ha= s 30 days from the date of notification to clean up the property. According to ordinance, if the property has not been cleaned up by that time, the City = may enter upon the property and abate the nuisance. The cost of the clean up w= ill be assessed against the property. Aisenbrey seconded, all present in favor; motion carried.

8:15 p.m. Ray and Randy Woehl left the meeting.=

NEW BUSINESS: Herman made a <= b>motion to hold a special meeting Friday, December 28 at 5 p.m. to conclude busine= ss for 2007. Kotalik seconded, all present in favor; motion carried.

City Engineer Vernon Arens called today informing us that road design engineer Brooke White has been assigned to a different project. No one has been re-assigned to the US Highway 18 project through Menno at this time. It is possible this could set our project back as the DOT is experiencing a lack= of funds, but we have not received word that the project has been delayed.

For Your Information: An email was received from Dave Hoffman informing us of IS300 classes being offered in Mitchell in January and &am= p; IS400 classes offered in Yankton in February for anyone still needing them= .

Maintenance was instructed to continue to remov= e the snow piles from the school and for reference, keep track of the hours it t= akes to do this.

Aaron Matthaei stated he removed his tractor and wanted to know if he had done enough to clean up his property. He hasnR= 17;t removed the items from the trailer in the driveway. The mayor told him if = the items weren’t gone by December 7, he would be ticketed.

Randy Woehl returned to the meeting at 8:20 p.m= .

Aisenbrey made a motion to adjourn at 8:= 26 p.m. until Monday, January 7. 2008 at 7:30 p.m. Herman seconded; all present in favor.

Huber made a motion to reconvene at 8:27 p.m. Mehlhaf seconded, all council present and in fav= or; motion carried.

Randy Woehl asked if he could purchase a piece = of ground from the city located south of the sale barn for a storage shed. Th= is will be put on the January agenda. No decision was made.

If he has to store all his stuff inside, Aaron Matthaei requested the following also be done: the city should store their property inside (culverts, etc.), planters by the wrought iron gates shoul= d be removed from the right-of-way by Darrell Guthmiller’s, the wagon should be removed from Dennis Aisenbrey’s and some cleaning up needs to be don= e at Gary Herman’s.
