MINUTES OF CITY COUNCIL PROCEEDINGS

MENNO, SOUTH DAKOTA

January 8, 2007

 

Mayor Larry Tolzin called the city council to order at 7:30 p.m. on January 8, 2007 in the council room at city hall. Council present: Dennis Aisenbrey, Galen Guthmiller (entered at 7:35 p.m.), Gary Herman, John Huber, Jerome Kotalik and Darrell Mehlhaf and Finance Officer Peggy Thranum and City Engineer Vernon Arens. City Attorney Ken Bertsch and Superintendent Roger Heckenlaible entered the meeting at 7:35 p.m. Erik Kaufman was also present.

 

Aisenbrey moved to approve the agenda with the following addition: SD DOT Pre-Planning meeting. Kotalik seconded, all present in favor; motion carried.

 

There will be a pre-planning meeting with DOT engineers concerning the grading, curb & gutter, storm sewer, structure and AC surfacing on US Highway 18 in Menno on Tuesday, January 9 at 9 a.m. in the meeting room at city hall. The meeting with the Office of Project Development-Utilities will begin at 1 p.m.

 

SCHEDULED BUSINESS: 7:30 p.m. Mike Wade did not appear for the water-sewer-garbage hearing he requested with the council.

 

YEARLY BUSINESS: Huber made a motion to name Menno State Bank as the official depository for 2007. Herman seconded, all present in favor; motion carried.

 

Mehlhaf made a motion to name the Hutchinson Herald as the official publication for 2007. Aisenbrey seconded, all present in favor; motion carried.

 

Aisenbrey made a motion to set the 2007 bond for the finance officer at $150,000. Huber seconded, all present in favor; motion carried.

 

Herman made a motion to place an ad in the paper for the following council terms expiring May 1, 2007 – Alderman, Ward I, Dennis Aisenbrey, 2-year term; Alderman, Ward II, Darrell Mehlhaf, 2-year term; Alderman, Ward III, Jerome Kotalik, 2-year term. Kotalik seconded, all present in favor; motion carried.

 

Aisenbrey made a motion to hold the city election in combination with the school election, if the school board approves. The election would be held in the English room at the high school on June 19, 2007 from 7 a.m. to 7 p.m. Huber seconded, all present in favor; motion carried. The election board and their pay will be decided at a later date.

 

SCHEDULED BUSINESS: 7:35 p.m. Arens reported inspecting the manholes from High Street to East Street. All three are brick and he recommends redoing them during the project and raised the possibility of moving them out of the lane of traffic. This raises the probable costs of the project to $87,000. The probable cost to add a fire hydrant and replace the water line between Country Pride and the Garden Gate is $29,000.

 

Arens has measured the pool, but requests that Architect Jim Schramm become involved with the plans, since the bathhouse is a public facility. The council granted permission for this and stated they wished to keep the plans simple. Arens stated he would try to have some plans ready for the February meeting. Arens left the meeting at 7:50 p.m.

 

YEARLY BUSINESS CONTINUED: Huber moved to approve Resolution #01-08-2007-01, 2007 Salary Resolution. Herman seconded, all present in favor; motion carried.

 

Resolution #01-08-2007-01

2007 Salary Resolution

 

                WHEREAS, SDCL 9-14-28 requires that, except as otherwise specially provided, the governing body of every municipality shall fix and determine by ordinance or resolution the amount of salaries and compensation of all municipal officers and the times at which the same shall be paid; and

 

                WHEREAS, the City Council shall publish the salaries for compliance with the provisions of SDCL.

 

                NOW, THEREFORE, BE IT RESOLVED, that the Governing Body of the City of Menno hereby approves and adopts the following salaries for the calendar year 2007. The four full-time employees will be paid bi-weekly and all others shall be paid monthly at the following monthly, daily or hourly wage.

 

Mayor - $150.00 per month, plus $25.00 per meeting/special meeting (Have to be present at meetings to be paid.)          

 

Council Members - $75.00 per month, plus $25.00 per meeting/special meeting (Have to be present at meetings to be paid.)

 

Any council member or mayor that attends a meeting on behalf of the city will be paid $25.00 per day. 

 

Cemetery Sexton - Marvin Schwitzer - $121.36 per month

 

Cleans City Hall - Adella Auch - $125.00 per month

 

Election Workers - $75 per day plus $10 for attending Election School

 

Ambulance Personnel - EMT-B - $20.00 per hour minimum

Ambulance Personnel - EMT-I (ALS Trips Only) $25.00 per hour minimum            

EVOC Drivers - $15.00 per hour minimum

Ambulance - Mutual Aid or No Transport Calls (DOA-MVA) $20.00 p/hr minimum

Ambulance - Continuing Education Classes, $20.00 per class

 

Attorney - Kenneth D. Bertsch - $76.00 per hour

OLD BUSINESS: “To Do List”: A hole was discovered behind the city hall that is believed to have been an old well or test well. It measured approximately 22’ deep and 1’ foot around. Maintenance filled it with gravel and will watch to see if something further needs to be done with it.

 

We received a letter from Mike Carr, DeWild Grant Reckert & Associates Co., concerning the sewer lines he viewed on the videos we sent him. He will be invited to attend the February council meeting to discuss his recommendations.

 

Mehlhaf made a motion to donate money to the Menno Area Development Corporation for acquisition and cleanup of property on the east side of Fifth Street between Poplar and Heil Streets in an amount up to $20,000; (the amount not to exceed the actual cost for the acquisition and cleanup). Guthmiller seconded, all present voted in favor; motion carried.

 

NEW BUSINESS: Huber made a motion to advertise for a pool manager for the 2007 swim season. Herman seconded, all present in favor; motion carried.

 

Mehlhaf made a motion to advertise for residential garbage pickup only. Kotalik seconded, all present in favor; motion carried.

 

Mehlhaf made a motion to advertise for quotes for mowing the cemetery for the 2007 growing season. Herman seconded, all present in favor; motion carried.

 

Huber moved for adoption of the following resolution for placement on the State Water Plan. Aisenbrey seconded, all present in favor; motion carried.

AUTHORIZING RESOLUTION #01-08-2007-02

STATE WATER PLAN

 

                WHEREAS, the City of Menno has identified the need to make certain improvements to its water and wastewater system; and

 

                WHEREAS, the City of Menno requests placement on the State Water Plan; and

 

                WHEREAS, the City of Menno is eligible for placement on the State Water Plan; and

 

                WHEREAS, with the submission of the State Water Plan application, the City of Menno assures and certifies that all State Water Plan program requirements will be fulfilled,

 

                THEREFOR, BE IT RESOLVED, that the City of Menno duly authorizes the submission of this State Water Plan application,

 

                AND BE IT FURTHER RESOLVED that the Mayor of Menno is authorized to execute this State Water Plan application for the City of Menno.

Mehlhaf made a motion to approve the fire chief’s 2006 Year End Report. Herman seconded, all present in favor; motion carried.

 

Menno Fire Department-2006 Year End Report: Rural – 3 Grass Fires, $0 Loss; Hay Fire, $3080 Loss; Grass-Trash Fire, $0 Loss; Grass-Tree Fire, Undetermined Loss; Barn-Pickup Fire, Undetermined Loss. City -  House Fire, $40,000 Loss; Car Fire, $2500 Loss; Shorted A/C-Heater, $2126 Loss. Olivet – Electrical Fire $50 Loss. A total of 13 hours and 25 minutes were spent on the 11 calls with an average of 12 firemen responding to each call.

 

Aisenbrey moved to approved the following list of active officers and members of the Menno Fire Department as elected at their Annual Meeting January 2, 2007. Guthmiller seconded, all present in favor; motion carried.

Huber reported the ambulance made 71 runs in 2006.

 

Herman made a motion to pay expenses for Thranum to attend the Annual Report Workshop in Sioux Falls on January 29. Guthmiller seconded, all present in favor; motion carried.

 

Mehlhaf made a motion to pay expenses for those city officers’ that wish to attend Municipal Government Day in Pierre February 7. Aisenbrey seconded, all present in favor; motion carried.

 

Huber moved to allow Heckenlaible and Sayler to attend a Stage 2 Disinfection By-Products Rule meeting in Rapid City February 7. Herman seconded, all present in favor; motion carried.

 

For Your Information: The minutes of the December development meeting and SEFP report were included in the council packets.

 

After review of the ordinances with the city attorney, Mehlhaf made a motion to deny all requests made by Mr. Mike Wade in his letter to the council concerning his water-sewer-garbage accounts and payments. Huber seconded, all council members present and in favor; motion carried. He needs to make arrangements to either have his bill paid by the 15th of the month or to pay in advance.

 

Herman made a motion to adjourn at 8:30 p.m. until Monday, February 5, 2007 at 7:30 p.m. Aisenbrey seconded, all present in favor.
