MENNO, SOUTH DAKOTA

June 18, 2008

 

The purpose of this meeting concerned a fence variance and use of the city dump truck.

 

Present at this meeting were: Mayor Larry Tolzin, Councilmen Dennis Aisenbrey, Jerry Fischer, Galen Guthmiller, John Huber, Jerome Kotalik, Darrell Mehlhaf, and Finance Officer Peggy Thranum. Also present were Bruce Anderson and John Woehl.

 

Mayor Tolzin called the meeting to order at 6:07 p.m.

 

Bruce Anderson requested an exemption from the fence ordinance to allow the Menno Area Development Corporation to erect a fence on the 5th Street property recently purchased from Ray Woehl.

 

RESOLUTION # 6-18-2008-03

 

FENCE EXEMPTION

 

Councilman John Huber introduced the following resolution and moved for its adoption:

 

WHEREAS the Menno Area Development Corporation, a South Dakota Nonprofit Corporation, of PO Box 432, Menno, SD 57045, has requested an exception from the fence ordinance, Chapter 13 of the 2005 REVISED ORDINANCES OF THE CITY OF MENNO, SOUTH DAKOTA, so that such corporation may construct a fence of eight (8) feet or less in height and adjacent to the public sidewalk on the property located between 218 S. 5th St. and 226 S. 5th St., in Menno, SD, and being described as:

 

Lot 6, LESS the North 2 ˝ feet thereof; the North 17 ˝ Feet of Lot 7; and all of Lot 7A, , all being in Block 1, of Andreas Mettler’s Addition, to the City of Menno, Hutchinson County, South Dakota.

 

NOW THEREFORE BE IT RESOLVED, that

 

            The Menno Area Development Corporation shall be granted an exception from Chapter 13 of the 2005 REVISED ORDINANCES OF THE CITY OF MENNO, SOUTH DAKOTA, only to the extent that such corporation may:

 

1)  Construct a fence of eight (8) feet or less in height in the front yard (that being the portion of the property facing 5th St.), in Menno, SD, and being described as:

 

Lot 6, LESS the North 2 ˝ feet thereof; the North 17 ˝ Feet of Lot 7; and all of Lot 7A, , all being in Block 1, of Andreas Mettler’s Addition, to the City of Menno, Hutchinson County, South Dakota.

 

2)      Place such fence closer than 18 inches from the public sidewalk on the west side of such property.

 

            This exception is granted on the condition that:  All other requirements set forth in Sections 13-1 to 13-4 inclusive, of the 2005 REVISED ORDINANCES OF THE CITY OF MENNO, SOUTH DAKOTA shall be followed.

 

Councilman Jerry Fischer seconded the motion, and after full and complete discussion, the resolution was unanimously adopted on roll call vote.

John Woehl asked the council’s permission to use the dump truck when work on the track field starts. Mehlhaf moved to allow the school to use the dump truck during the track renovation. Aisenbrey seconded; all present in favor.           

 

Aisenbrey moved to adjourn at 6:15 p.m. Guthmiller seconded; motion carried.
