MINUTES OF CITY COUNCIL PROCEEDINGS
MENNO, SOUTH DAKOTA
Mayor Larry Tolzin called the city council to order at 6:00 p.m. on July 2, 2008 in the council room at city hall. Council present: Dennis Aisenbrey, Jerry Fischer, Galen Guthmiller, John Huber, Jerome Kotalik and Darrell Mehlhaf and Finance Officer Peggy Thranum, City Attorney Ken Bertsch (entered at 6:07) and Superintendent Roger Heckenlaible. Jerome Hoff, Erik Kaufman, and Aaron Matthaei were also present.
Guthmiller moved to approve the agenda with the following addition: District III picnic. Kotalik seconded; all in favor.
REGULAR MEETING ITEMS: Huber moved to approve the minutes of the June 2 regular meeting, June 18 canvass meeting and June 18 special meeting. Guthmiller seconded; all in favor.
Mehlhaf moved to approve the June finance report. Fischer seconded; all in favor.

Kotalik moved to accept the West Nile Mosquito Control Grant received from the SD Department of Health in the amount of $1092. Guthmiller seconded; all present in favor. The state grant revenue and the West Nile supply expenses of the general fund budget will be increased by this amount.

OLD BUSINESS: Nothing was added to the “To Do List”.
Mehlhaf stated the officer on duty should collect any fees for camping at the city park. Huber moved to charge $10 per day for camping fee and electricity at the city park. Aisenbrey seconded; all in favor.
Rocky Zeeb entered the meeting at 6:09 p.m.
Aisenbrey moved to have 10 days per camper be the limit to camp at the city park. Fischer seconded; all in favor. Mehlhaf will speak to Maxwell Colony about making a sign to be placed at the park concerning the rates and length of stay.
The city attorney was unable to determine if there were any rules or regulations requiring us to have yield/stop signs along our truck route. Thranum had spoken to an attorney with the DOT and he stated it would depend on the type of intersection, type of traffic and points of danger. If you have an intersection where you have a lot of accidents, you may need to have a sign. The council took no action.
The city attorney has determined that we have jurisdiction within one mile of the corporate limits of the city to enforce our ordinances. Due to this, he has been directed by the council to draft a letter asking the owners of property on the east edge of town to clean up their property.
Scheduled Business: Rocky Zeeb asked the council for an increase in residential garbage. Fuel has risen from $2.54 to $4.55 per gallon since the contract was bid. Attorney Bertsch stated according to our contract, the price per unit may be escalated if expenses involved in providing such service warrant an increase. The rise in fuel prices would document a reason for such an increase. Following discussion, Mehlhaf moved to accept the $1 increase the city pays in residential garbage from $11.25 to $12.25 per unit to begin with the July payment. Kotalik seconded; all in favor. Zeeb left the meeting.

Jerry Fischer was sworn in as alderman for Ward I and Jerome Hoff as alderman for Ward III.
The mayor called the meeting to order at 6:28 p.m.
New Business: Aisenbrey moved to elect Jerome Hoff as council president. Guthmiller seconded; all in favor.
Guthmiller moved to elect Dennis Aisenbrey as council vice-president. Kotalik seconded; all in favor.

RESOLUTION
Alderman Galen Guthmiller introduced the following resolution and moved for its adoption.
LET IT BE RESOLVED that the City of Menno, South Dakota extends a sincere “Thank You” to Gary Herman for his Twenty eight (28) Years of dedicated service as Alderman of Ward I to the City and Citizens of Menno, South Dakota.
Alderman Jerry Fischer seconded the motion.
Upon a unanimous vote the resolution was declared adopted.

RESOLUTION
Alderman Darrell Mehlhaf introduced the following resolution and moved for its adoption.
LET IT BE RESOLVED that the City of Menno, South Dakota extends a sincere “Thank You” to John Huber for his Eight (8) Years of dedicated service as Alderman of Ward III to the City and Citizens of Menno, South Dakota.
Alderman Galen Guthmiller seconded the motion.
Upon a unanimous vote the resolution was declared adopted.

Kotalik moved to approve the first reading of Supplemental Appropriations Ordinance #2008-01, an ordinance providing appropriations to supplement the police, street and pool departments within the general fund. Hoff seconded; all in favor.
Drainage on High and Jackson Streets was discussed. Cleaning out the ditch along the railroad right-of-way and by Peace parsonage was discussed. Mehlhaf will check with the property owner on the north edge of town about draining into the creek.
Kotalik moved to allow Lorelei Hoff and family to place two monuments at no cost to the city at the Menno Cemetery near the monument where the Memorial Day services are held. Guthmiller seconded; all in favor. The monuments will resemble those in Arlington Cemetery and be placed in honor of Wilmer W. Bender and Calvin J. Hoff, the first two veterans from this area to be killed in World War 2.
Kotalik moved to allow Fifth Street to be blocked off from Menno Mercantile to Walter Welding from 3 p.m. until after the Car Show August 23. Mehlhaf seconded; all in favor.
Hoff moved to set August 4 at 7:35 p.m. as the hearing date and time for a Temporary Malt Beverage Permit for the Menno Fire Department on August 23, 2008 from 3 p.m. until 10 p.m. at the Menno Fire Hall. Fischer seconded; all present in favor.
Mehlhaf moved to hold a hearing August 4 at 7:36 p.m. for a permit allowing the consumption of alcohol on public property and to allow the alley between the Schnitz and the Beer Garden to be blocked off and used for a dance the night of August 23 from 3 p.m. until 2 a.m. August 24. The band will quit playing at 1 a.m. on August 24th. The alley may be blocked with barricades in the morning and a fence will be put up prior to the dance. Guthmiller seconded; all present in favor.
Kotalik moved to hire John Woehl to paint stripes on Fifth Street. (Woehl will furnish the paint and labor for $400-$450.) Aisenbrey seconded; all in favor.
Mehlhaf moved to pay council expenses to attend STIP meetings in Yankton at the District III office at 1808 Summit Street on July 9 beginning at 10:00 a.m. and at Mitchell Technical Institute Technology Center at 1800 East Spruce July 17 beginning at 7 p.m. Guthmiller seconded; all in favor. Tolzin stated we could car pool to Mitchell using the school vans. They will leave the school at 5:45 p.m. on July 17.
Mehlhaf moved to table any decision concerning rates for utilities until the July 28th meeting. Kotalik seconded; all in favor. Water books are to be printed and if rates change, notice will be mailed to the consumer.
Fischer moved to hold the budget meeting July 28 beginning at 7 p.m. Aisenbrey seconded; all in favor.
Aisenbrey moved to begin the annual water meter reading the week of July 28. Hoff seconded; all in favor.
Following discussion, the decision was made to keep the light poles removed from the tennis courts.
Hoff moved to declare the 2000 Ford police car and the 1977 Dodge utility truck surplus property. Aisenbrey seconded; all in favor.
Mehlhaf moved to declare the 1974 Intl, model 1700, dump truck surplus property. Fischer seconded; all in favor.
Fischer moved to appoint David Bender, J.W. Schnaidt and Greg Wilcoxon as the appraisers for the surplus property. Hoff seconded; all in favor.
Mehlhaf moved to allow Heckenlaible to purchase 4 reasonably priced loungers for the pool. Aisenbrey seconded; all in favor.
It was suggested to paint and clean up the bathrooms at the city park and to give a key to the coaches for the restrooms at the softball field.
For Your Information: The council is invited to a 35th anniversary celebration for Planning and Development District III to be held at the Snake Creek recreation area on July 11 beginning at 11 a.m.
The packet from the June development meeting and the SEFP report were included in the council packets.
Aisenbrey moved to adjourn at 7:15 p.m. until Monday, August 4, 2008 at 7:30 p.m. Hoff seconded, all in favor.
