MINUTES OF CITY COUNCIL PROCEEDINGS

MENNO, SOUTH DAKOTA

December 1, 2008

Mayor Larry Tolzin called the city council to order at 7= :30 p.m. on December 1, 2008 in the council room at city hall. Council pres= ent: Dennis Aisenbrey, Jerry Fischer, Galen Guthmiller, Jerome Hoff, Jerome Kotalik an= d Darrell Mehlhaf, Finance Officer Peg= gy Thranum and Superintendent Roger Heckenlaible. Also present were Erik Kauf= man, Aaron Matthaei, Christian Sorlien and Dale Weiss.

 

Hoff m= oved to approve the agenda. Fischer seconded; all in favor. A thank you was read from Marvin Schwitzer’s family.

 

REGULAR MEETING ITEMS: Hoff moved to approve the minutes of the November 6 regular meeting. Kotalik seconded; a= ll in favor.

Old Business: “To Do List”: Vantek has replaced t= he motherboard for the warning siren and two of the batteries were bad. All r= adios must be narrow band by 2013; all ours should be compliant except for the f= ire department pagers.

 

Council consensus was to leave the restored dra= inage ditch near the Glenn Kirschenman property as it is.

 

After reviewing the Sioux Falls ordinances and conferring with our atto= rney, no changes were made to our Nuisance Ordinance penalties.

 

New Business: Approval of the Letting Agreement betwee= n the state and city for the drainage ditch in the NE corner of Menno will not be given until the year end meeting. There are questions concerning the trans= fer of the perpetual easement for the construction, maintenance and operation = of an open drainage ditch which is not in the city limits.

 

Kotalik moved to hold a special meeting = on December 29 at 5:30 p.m. in the council room at city hall to finish business for 2008. Aisenbrey secon= ded; all in favor.

 

Compensating the party that accepts the compost= from the restricted use site was discussed. No action was taken.

 

Fischer moved to set January 5, 2009 at = 7:35 p.m. as the date and time= to hold a hearing on the application for the following license. Guthmiller seconded; all in favor.

  • New - Package (Off-Sale) Liquor– Ruth Mettler, d.b.a., The Beer Garden, Lots 9-10, Block = 2, Original Plat, City of Menno.

 

Mehlhaf moved to assign and transfer unto AAA Collections, Inc. accoun= t number 20075 in the amount of $430. Hoff seconded; all in favor.

 

We received notice t= hat the Board of Water and Natural Resources approved the placement of the City of= Menno Water and Sewer Improvements project onto the 2009 S= tate Water Facilities Plan. The project will remain on the State Water Faciliti= es Plan through calendar year 2010 and makes our project eligible to apply to= the department’s programs for funding consideration.

For Your Information: The packet from the November MADC meetin= g and the SEFP report were included in the council packets.

 

Christian Sorlien asked for his ticket to be dismissed. No action was taken. He left the meeting at 7:52 p.m.

 

Dale Weiss asked that the gym committee and fin= ance officer meet with the school business manager and superintendent to revise= the current contract for the school/city auditorium use.

 

Fischer moved to adjourn at 7= :55 p.m. until Monday, January 5, 2009 at = 7:30 p.m. Aisenbrey seconded, = motion carried.
