MINUTES OF CITY COUNCIL PROCEEDINGS
MENNO, SOUTH DAKOTA
Mayor Larry Tolzin called the city council to order at 7:30 p.m. on May 5, 2008 in the council room at city hall. Council present: Dennis Aisenbrey, Galen Guthmiller, John Huber, Jerome Kotalik and Darrell Mehlhaf and Finance Officer Peggy Thranum and Superintendent Roger Heckenlaible. Jerry Fischer, Mark Hento Erik Kaufman, Aaron Matthaei and Jerome Hoff were also present.
Aisenbrey moved to approve the agenda with the addition of a police car. Huber seconded; motion carried.
REGULAR MEETING ITEMS: Kotalik moved to approve the minutes of the April 7 regular meeting. Aisenbrey seconded; motion carried.
Guthmiller moved to approve the April finance report. Huber seconded; motion carried.

Huber moved to transfer $20,000 from the Sales Tax Fund into the General Fund per the budget. Aisenbrey seconded; motion carried.

Mehlhaf moved to release the following funds per budget: Athletic Club 4000.00, Baseball Association 1500.00, and Junior Legion Baseball 1000.00. Huber seconded; motion carried.
OLD BUSINESS: “To Do List” Need gravel at the cemetery and install one-way valves at the camper dump station.
Arens Engineering submitted information stating there isn’t a lot of drop for drainage at the ball field. Huber moved to table discussion on the drainage problem at the ball field until the June meeting until further information is gathered. Guthmiller seconded; motion carried.
Huber moved to allow Hento to purchase a 2005 Ford Crown Victoria from Surplus Property in Huron for $10,500. Guthmiller seconded; motion carried. (Permission to purchase a police car had previously been given at the February 5, 2007 council meeting. Money was set aside for this purpose.)
NEW BUSINESS: Since money was set aside for this purpose, Kotalik moved to allow Heckenlaible to purchase a 91 IHC 4000 dump truck from Surplus Property for $11,300. Guthmiller seconded; motion carried.
Aisenbrey moved to approve Tolzin’s appointment of Jerry Fischer to complete the term of Alderman Ward I left vacant by Gary Herman’s death. Huber seconded; motion carried.
7: 50 p.m. Jerry Fischer took the oath of office and his seat at the council table. Hento left the meeting.
Mehlhaf moved to pay expenses for Thranum to attend Municipal Clerk’s School in Vermillion July 7-11. Huber seconded; motion carried.
Mehlhaf moved to have the next regular council meeting on July 2 at 6 p.m. Huber seconded; motion carried.
Guthmiller moved to set June 2 at 7:35 p.m. in the meeting room at city hall as the date, time and place for a hearing on the applications for the following malt beverage licenses. Aisenbrey seconded, all present in favor; motion carried.
Kotalik moved to allow the Menno Baseball Association to sponsor a fireworks display on July 4. Huber seconded, motion carried.
Huber moved to hold a hearing June 2 at 7:36 p.m. concerning a permit allowing consumption of alcohol in a public place which will be used for a dance the night of July 5 from 4 p.m. until 2 a.m. July 6. The band must quit playing at 1 a.m. on July 6. The permit would allow the alley between the Schnitz and the Beer Garden to be blocked off with barricades in the morning, but a fence must be put up prior to the dance. Fischer seconded; motion carried.
Mehlhaf moved to allow Tracy & Terry Goehring to run the concession stand at the softball field this summer. Aisenbrey seconded; motion carried.
Aisenbrey moved to place an ad in the paper informing property owners of Chapter 40 of the city ordinances which states they must keep their property properly mown and sprayed for weeds. If the property owner fails to do this, the city will mow and/or spray and assess the cost against the property. Guthmiller seconded; motion carried.
Huber moved to have Tom Ulmer spray the city cemetery for $430. Kotalik seconded; motion carried.
Mehlhaf moved to allow people to take wood from the restricted use site for their own use, first come first served, as long as they do not cut it out there. Guthmiller seconded; motion carried.
7:59 p.m. Gary Schelske entered the meeting.
Huber moved to purchase a load of lime for the softball field and use some for the baseball field. Fischer seconded; motion carried.
The Volunteer Ambulance Contract signed by SuAnne Knutson states “Should I not be able to fulfill this contract for any reason, I will reimburse the City of Menno for all expenses paid on my behalf.” The council will stand by the terms of the contract. Knutson will be required to reimburse the city the $430 paid on her behalf for the book and 120-hour EMT course.
Mehlhaf moved to allow Jenna Guthmiller and Trevor Bertsch to give swim lessons this season and to keep all proceeds from the lessons. Huber seconded; motion carried.
Huber moved to approve the bid from Stepanek for installing three camper outlets in the park east of what used to be the tennis courts in the amount of $2920. (This bid is contingent on using existing wires to lights on the southwest side of the tennis court.) Aisenbrey seconded; motion carried.
Scheduled Business: 8:10 p.m. Gary Schelske addressed the council concerning the fact that NorthWestern Energy is not going to replace Brad Knutson in Menno. He stated we had gone through this before, service dropped when we had no repair man living in town and we had to go through the Public Utilities Commission to get things changed. He asked the council to investigate owning our own municipal electric.
Huber moved to hold a special meeting Thursday, May 15 at 7 p.m. at city hall to investigate owning our own municipal electric. Guthmiller seconded; motion carried. Tom Marvin of the SD Municipal League will be contacted to come to the meeting to discuss what this involves.
Mayor Tolzin recognized Fred Sayler and Roger Heckenlaible for being awarded a Drinking Water Certificate of Achievement Award. The award is for outstanding water system operations and environmental compliance with state drinking water standards for the past year. Congratulations!
