MINUTES OF CITY COUNCIL PROCEEDINGS
MENNO, SOUTH DAKOTA
Mayor Larry Tolzin called the city council to order at 7:30 p.m. on January 5, 2009 in the council room at city hall. Council present: Dennis Aisenbrey, Jerry Fischer, Galen Guthmiller, Jerome Hoff, Jerome Kotalik and Darrell Mehlhaf; Finance Officer Peggy Thranum, Superintendent Fred Sayler, Fire Chief John Huber and Police Chief Mark Hento. Erik Kaufman and Aaron Matthaei were also present.
Fischer moved to approve the agenda with the deletion of Executive Session. Guthmiller seconded; motion carried.
YEARLY BUSINESS: Hoff moved to name Menno State Bank as the official depository for 2009. Aisenbrey seconded: motion carried.
Fischer moved to name the Hutchinson Herald as the official publication for 2009. Guthmiller seconded; motion carried.
Hoff moved to set the 2009 bond for the finance officer at $150,000. Kotalik seconded; motion carried.
The following council terms will expire in 2009 – Alderman, Ward I, Dennis Aisenbrey, 2-year term; Alderman, Ward II, Darrell Mehlhaf, 2-year term; Alderman, Ward III, Jerome Kotalik, 2-year term.
Fischer moved to hold the combined city-school election on April 14th in the meeting room at city hall. Polls will be open from 7 a.m. to 7 p.m. election day. Approval of the election agreement between the city and school is tabled to the next meeting. Hoff seconded; motion carried.
Mehlhaf moved to approve the following to serve on the election board and to pay each $100 for the day and $10 if they attend election school: Joan Nusz, Superintendent, Ward I; Gloria Okrina, Ward II and Lorraine Mammenga, Ward III. Guthmiller seconded; motion carried.
Guthmiller moved to approve Resolution #01-05-2009-01, 2009 Salary Resolution. Aisenbrey seconded, all present in favor; motion carried.

2009 Salary Resolution
WHEREAS, SDCL 9-14-28 requires that, except as otherwise specially provided, the governing body of every municipality shall fix and determine by ordinance or resolution the amount of salaries and compensation of all municipal officers and the times at which the same shall be paid; and
WHEREAS, the City Council shall publish the salaries for compliance with the provisions of SDCL.
NOW, THEREFORE, BE IT RESOLVED, that the Governing Body of the City of Menno hereby approves and adopts the following salaries for the calendar year 2009. The four full-time employees will be paid bi-weekly and all others shall be paid monthly at the following monthly, daily or hourly wage.
Mayor - $150.00 per month, plus $25.00 per meeting/special meeting (Have to be present at meetings to be paid.)
Council Members - $75.00 per month, plus $25.00 per meeting/special meeting (Have to be present at meetings to be paid.)
Any council member or mayor that attends a meeting on behalf of the city will be paid $25.00 per day.
Cemetery Sexton – Ammon Auch - $128.75 per month
Cleans City Hall - Adella Auch - $132.61 per month
Election Workers - $100 per day plus $10 for attending Election School
Ambulance Personnel - EMT-B - $20.00 per hour minimum
Ambulance Personnel - EMT-I (ALS Trips Only) $25.00 per hour minimum
EVOC Drivers - $15.00 per hour minimum
Ambulance - Mutual Aid or No Transport Calls (DOA-MVA) $20.00 p/hr minimum
Ambulance - Continuing Education Classes, $20.00 per class
Attorney - Kenneth D. Bertsch - $82.00 per hour
Clean “Old Fire Station” Meeting Room - Adella Auch (if needed) $7.25 per hour
Economic Development Coordinator - Peggy Thranum $11.39 per hour
Finance Officer - Peggy Thranum - $11.39 per hour
Librarian - Angeline Schoenfish $9.09 per hour
Maintenance - Parks - Ewald Herrboldt $7.96 per hour
Police Chief - Mark D. Hento - $14.39 per hour

Mehlhaf made a motion to approve the following warrants and to make a contribution to Experience Works in the amount of $500. Fischer seconded; motion carried.

SCHEDULED BUSINESS: Guthmiller moved to approve the following license. Kotalik seconded; motion carried.
Mehlhaf moved to allow Police Chief Mark Hento to purchase a Preliminary Breath Tester, Alco-Sensor III for approximately $469. Hoff seconded; motion carried. Hento was asked to bring prices to the next council meeting for a digital camera and printer.
Fischer moved to allow Hento to have Brian Humphrey as a relief police officer if Galen Heckenlaible can’t work. Guthmiller seconded; motion carried. Humphrey is a Game Warden and certified law enforcement officer.
OLD BUSINESS: “To Do List”: It was requested of maintenance to do repair work on the Christmas garland and lights as time allows.
NEW BUSINESS: Guthmiller moved to advertise for a pool manager for the 2009 swim season. Fischer seconded; motion carried.
Hoff moved to allow Sayler and Heckenlaible to attend a Pipeline Repair & Disinfection Seminar in Sioux Falls on January 22. Kotalik seconded; motion carried.
Fischer moved to allow Sayler and Heckenlaible to attend the following workshops in Sioux Falls: Basic Wastewater Treatment February 24-26 and Small Water Treatment March 3 and the Hydrant and Distribution Workshop when it is held in April or May. Guthmiller seconded; motion carried.
No action was taken on the Landfill and Restricted Use Site Disaster Training.
Fischer moved to approve the fire chief’s 2008 Year End Report. Hoff seconded; motion carried.
Menno Fire Department-2008 Year End Report: Rural – 2 Grass Fires, $0 Loss; 1 Furnace Fire, $2500 Loss; 1 Electrical Fire, $500 Loss; 1 Chimney Fire, $500 Loss. City - Grass Fire, $0 Loss; 1 Pickup Fire, $6000 Loss; 1 House Fire, $3000 Loss . Medical - 1 Car Accident $25,000 Loss; 1 Tractor Accident, $105,000 Loss. A total of 12 hours and 25 minutes were spent on the 10 calls with an average of 11 firemen responding to each call.
Due to the lower fuel prices, Fischer moved to lower the amount the city pays to the garbage contractor by $1, back to the contract price of $11.25 per unit. Guthmiller seconded; motion carried.
Guthmiller moved to raise ambulance rates to fall in line with what Medicare and Wellmark Blue Cross Blue Shield pay. Hoff seconded; motion carried. Rates will be as follows retroactive to January 1, 2009: BLS $315, BLS-E $500, ALS-1 E $600 and $12/mile.
Aisenbrey moved to appoint Tolzin as the District III representative. Fischer seconded; motion carried.
No action was taken on Municipal Government Day in Pierre on February 4.
Due to recent repairs, Mehlhaf moved to increase the value on the pool bathhouse $10,000 to $62,000. Guthmiller seconded; motion carried.
Huber and Hento left the meeting at 8:07 p.m.
Discussion was had on allowing sump pumps to drain into the sewer system in the winter time. An example was shared of how to plumb so the pump can be drained outside in the spring and into the sewer in the winter. This example has a locking cap on the drain into the sewer that is controlled by the city. Further discussion was tabled to the February council meeting.
