MINUTES OF CITY COUNCIL PROCEEDINGS
MENNO, SOUTH DAKOTA
Mayor Larry Tolzin called the city council to order at 7:30 p.m. on March 2, 2009 in the council room at city hall. Council present: Dennis Aisenbrey, Jerry Fischer, Galen Guthmiller, Jerome Hoff, Jerome Kotalik and Darrell Mehlhaf; Finance Officer Peggy Thranum and Superintendent Fred Sayler. Bruce Anderson, Erik Kaufman and Aaron Matthaei were also present.
Fischer moved to approve the agenda with the following additions: Wastewater Seminar and Mayor Letter Writing. Aisenbrey seconded; motion carried.
REGULAR MEETING ITEMS: Guthmiller moved to approve the minutes of the February 2 regular meeting with the following correction: the minutes were signed by Council President Jerome E Hoff as Mayor Tolzin was absent from that meeting. Hoff seconded; motion carried.
Aisenbrey moved to approve the corrected January finance report and the February finance report. Mehlhaf seconded; motion carried. The formulas in the previous report were incorrect, giving an incorrect total for receipts in the funds.

SCHEDULED BUSINESS: Five quotes were received for the brome hay as follows: Bryan Kludt $425, Josh Neuharth $420, David Rempfer $350, Terry/Marion Auch $400 and Doug Lehr $370. Aisenbrey moved to accept the $425 quote from Bryan Kludt for the 7-acres of brome hay at the lagoon site for the 2009 haying season. Hoff seconded; motion carried.
The following applications were received for life guards: Taylor Fischer, Tessa Goehring, Cody Herrboldt, Trevor Bertsch, Michelle Zeeb and Jenna Guthmiller. Hoff moved to hire the 3 returning guards as full-time for the 2009 swim season: Trevor Bertsch, Cody Herrboldt and Jenna Guthmiller. Kotalik seconded; motion carried.
Guthmiller moved to hire the other 3 applicants as part-time guards and they be scheduled at the discretion of the pool manager: Taylor Fischer, Tessa Goehring and Michelle Zeeb. Kotalik seconded; motion carried.
Bruce Anderson asked the council to share the cost of the handicap signs to be placed at the Legion and by the city shop. Guthmiller moved to pay for 1 sign, ½ the freight charges and the bracket for the sign and the Legion pay the rest. Fischer seconded; motion carried. Anderson left the meeting.
OLD BUSINESS: “To Do List”: The mayor complimented maintenance on the good job they did clearing the streets.
Mehlhaf moved to approve the revised Restricted Use Site policy. Hoff seconded; motion carried.
City of Menno Restricted Use Site Policy
It will be the policy of the City of Menno to have the restricted use site open for public use at the following times:
REGULAR HOURS:
The restricted use site will be open for public use on Wednesdays and Saturdays during the season. The City Council and the weather determine the “season”. The hours the site will be open are from 9 a.m. to 12 noon and 1 p.m. to 4 p.m.
DURING THE WINTER MONTHS:
The restricted use site will be open for public use on the second and fourth Saturday of the month during the winter months, weather permitting. The hours the site will be open are from 9 a.m. to 12 noon.
The “winter months” will be determined by when the site has closed for regular hours. (This is also determined by the weather. If it is nice, the site may stay open longer for the season. If we have a lot of snow, it may close earlier for the season. The City Council decides this.)
AFTER HOURS ADMITTANCE:
Anyone wishing admittance to the site after hours must contact the manager of the restricted use site and pay a $10.00 admittance fee. If the manager cannot be contacted, admittance may be allowed by contacting one of the city maintenance superintendents and paying them $10.00 for admittance.
It will be the policy of the City of Menno to accept the following items at the restricted use site from residents of Menno only and to charge the listed fees for certain items:
DUMPING FEES:
The following dumping fees will be charged:
1. White Goods $10.00 per item
2. Asphalt Shingles/Painted Wood $10.00 per pickup load or less
$25.00 for anything larger than a pickup load (Truck, Trailer, or Wagon)
Once items have been deposited at the restricted use site, they become the property of the City of Menno and may only be removed with the permission of the City Council. (This does not include wood that will be used as firewood or grass and leaves that will be used as mulch. Wood may not be cut at the restriced use site.)

Mehlhaf moved to purchase a G-Force slide from Inter-Fab for the swimming pool for approximately $2800. Fischer seconded; motion carried.
Two estimates for a roof on the pool bathhouse were presented. Option 1: A whole new truss roof to cover the entire building, to include sky lights in the gable ends, $4670.39. Option 2: A roof to match the existing roof (roof over concession stand shows water damage from leakage), no sky lights - would need to use lights at all times, $2625.22. Fischer moved to accept the estimate of $4670.39 for Option 1 for the new roof on the pool bathhouse. Guthmiller seconded; motion carried.
Hoff moved to advertise for a contractor to build a roof for the pool bathhouse according to the specifications of estimate Option 1. Guthmiller seconded; motion carried.
NEW BUSINESS: Mehlhaf moved to set the date for the Equalization Meeting on Monday, March 16, 2009 beginning at 6 p.m. Guthmiller seconded; motion carried.
Mehlhaf moved to approve two (2) permanent easement agreements for drainage and utility purposes connected with the drainage project the SD DOT will be doing this spring to improve drainage around the northeast side of Menno. Fischer seconded; motion carried.
Hoff moved to adopt an investment policy for the city. Guthmiller seconded; motion carried. A copy of the policy is on file in the finance office.
Guthmiller moved to adopt the Red Flags Identity Theft Policy. Hoff seconded; motion carried. A copy of the policy is on file in the finance office.
Fischer moved to pay Mark/Bonnie Heirigs $600 per cemetery mowing for the 2009 season. Aisenbrey seconded; motion carried.
Mehlhaf moved to pay ½ the price of CPR certification for firemen retroactive to January 1, 2009. Guthmiller seconded; motion carried.
Hoff moved to pay expenses to have Galen Heckenlaible attend a training class for restricted use site operators at Chamberlain on March 25. Guthmiller seconded; motion carried.
No action was taken on the Code Enforcement conference.
Kotalik moved to pay expenses for council/employees wishing to attend the Legislative Dinner in Mitchell on March 19. Aisenbrey seconded; motion carried.
Mehlhaf moved to pay expenses for council/employees wishing to attend the District III meeting in Vermillion on March 31. Fischer seconded; motion carried.
Hoff moved to adopt the Silver Star Banner Day resolution. Guthmiller seconded; motion carried.

RESOLUTION #3-2-2009-2
WHEREAS, the City of Menno has always honored the sacrifice of the men and women in the Armed Forces and
WHEREAS, The Silver Star Families of America was formed to make sure we remember the blood sacrifice of our wounded and ill by designing and manufacturing a Silver Star Banner and Flag and
WHEREAS, to date The Silver Star Families of America has freely given thousands of Silver Star Banners to the wounded and their families, and
WHEREAS, the members of The Silver Star Families of America have worked tirelessly to provide the wounded of this City and Country with Silver Star Banners, Flags and care packages, and
WHEREAS, The Silver Star Families of America’s sole mission is that every time someone sees a Silver Star Banner in a window or a Silver Star Flag flying, that people remember the sacrificed for this City, State and Nation and
WHEREAS, the people and Mayor of Menno wish that the sacrifice of so many in our Armed Forces never be forgotten
NOW THEREFORE, I, LARRY TOLZIN, MAYOR OF THE CITY OF MENNO do hereby proclaim
My appreciation of the Silver Star Families of America and honor their commitment to our wounded Armed Forces members. I hereby declare May 1st “SILVER STAR BANNER DAY” the permanent and official day to honor the wounded and ill Soldiers of the City of Menno.

No action was taken on the defensive driving course.
ICS 300 course classes will be held at 807 Capitol Street in Yankton on March 21-22 and ICS 400 course classes will be held at 201 West 1st Avenue in Mitchell April 25-26.
For Your Information: The minutes of the February development meeting and SEFP report were included in the council packets.
Part of the Lower James RC&D Annual Report was shared with the council. It contained an article remembering Gary Herman and honoring him for his service.
No action was taken on the wastewater seminar.
Mayor Tolzin stated he would have copies made of any letters he sends out for the council’s information.
The exhaust fan has been installed in the basement. It has a timer and is set to run for 15 minutes every 3 hours. It seems to be helping with the smell.
