MINUTES OF CITY COUNCIL PROCEEDINGS
MENNO, SOUTH DAKOTA
Mayor Larry Tolzin called the city council to order at 7:30 p.m. on May 4, 2009 in the council room at city hall. Council present: Dennis Aisenbrey, Jerry Fischer, Galen Guthmiller, Jerome Hoff, Jerome Kotalik and Darrell Mehlhaf; Finance Officer Peggy Thranum and Superintendent Fred Sayler. Erik Kaufman, Aaron Matthaei, Scott Simonsen and Christian Sorlien were also present.
Fischer moved to approve the agenda with the following deletion/addition: Delete-Dave Hoffman and Add Nuisance Ordinances. Kotalik seconded; all ayes.
REGULAR MEETING ITEMS: Hoff moved to approve the minutes of the April 6 regular meeting and the April 20 special meeting. Guthmiller seconded; all ayes.
Mehlhaf moved to approve the April finance report. Hoff seconded; all ayes.

Mehlhaf moved to release the following annual contributions: Athletic Club $4000 and Junior Legion Baseball $500. Hoff seconded; all ayes.
SCHEDULED BUSINESS: Dave Hoffman rescheduled to the June council meeting because of a conflict.
Hoff moved to table any action on a lease for antennas on our water tower as we didn’t receive the paper work until today. Fischer seconded; all ayes.
OLD BUSINESS: “To Do List” Mehlhaf asked when they planned to install the culverts by Kirschenman’s shed; Sayler thought they would do them this week.
Guthmiller moved to lift the carpet and sand down the concrete in the finance office. Fischer seconded; 5 ayes, Hoff nay.
The improvement suggestions from Safety Benefits have been completed and will be mailed.
Mehlhaf moved to approve a Loss Control Policy. Guthmiller seconded; all ayes.
Stahl is asking $6000 for his property. Fischer will speak with him again before the next meeting and also see if he can get an estimate what it would cost to clear the lot. Fischer moved to table further discussion on the Stahl property to the June meeting. Guthmiller seconded; all ayes.
Guthmiller moved to adjourn. Fischer seconded; all ayes.
Scott Simonsen, Darrell Mehlhaf and Jerome Kotalik took the oath of office.
Gary Schelske entered the meeting.
The meeting reconvened at 7:53 p.m.
Scheduled Business continued: Schelske requested the council look into upgrading our ISO Public Protection Classification from a 7 to a 6. Insurance companies use this rating to determine insurance rates. The PPC evaluation process evaluates 3 major areas: fire alarm and communications systems, fire department (first-alarm response, equipment, personnel and training) and water supply. Fire Chief Huber will begin the paper work.
Schelske has tried to keep abreast of the municipal electric development in Wagner. We have heard nothing as to how they are progressing.
NEW BUSINESS: Guthmiller moved to elect Darrell Mehlhaf as council president. Fischer seconded; all ayes
Mehlhaf moved to elect Jerome Hoff has council vice-president. Guthmiller seconded; all ayes.
Alderman Darrell Mehlhaf introduced the following resolution and moved for its adoption.
LET IT BE RESOLVED that the City of Menno, South Dakota extends a sincere “Thank You” to Dennis Aisenbrey for his Twelve (12) Years of dedicated service as Alderman of Ward I to the City and Citizens of Menno, South Dakota.
Alderman Jerry Fischer seconded the motion. Upon a unanimous vote the resolution was declared adopted.

Hoff moved to accept the appointed committees and officers. Guthmiller seconded; all ayes.
Kotalik moved to pay expenses for Thranum to attend the SEAFOG meeting in Sioux Falls May 20 and the Municipal Clerk Program in Vermillion July 6-10. Hoff seconded; all ayes.
Hoff moved to have the next regular council meeting on July 2. Simonsen seconded; all ayes.
Our pool has to come into compliance with the Virginia Graeme Baker Act before it can be opened. Hoff moved to approve the $6430 estimate for work on the pool drains from MC&R Pool and the $3000 estimate for repair work to our liner from RenoSys Corp. to bring us in line with Federal guidelines. Fischer seconded; all ayes.
Guthmiller moved to make the following changes to pool rates for the 2009 swim season: single pass $40, family pass 2-4 people $70, family pass 5 people $80, family pass 6 people, $90, etc., adding a $10 increase for each person added to the family pass. Simonsen seconded; all ayes. Other rates will remain the same: Adult daily/$3, Child daily/$2, 7-day pass/$10. (The 7-day pass is for visitors to our town, not people that live in the area.) Taxes are included in the rates.
Fischer moved to allow the manager to set the time for lap-swim, to advertise it and increase the fee to $2 per session. Guthmiller seconded; all ayes.
Kotalik moved to set the TENTATIVE opening date for the pool as May 23 (Installation of the drain covers and other repair work could delay this.) Closing date for the pool was set as August 23. Hoff seconded; all ayes.
Fischer moved to hold a hearing on June 1 at 7:35 p.m. concerning a permit allowing consumption of alcohol in a public place. Guthmiller seconded; all ayes. The permit is for an alley dance between the Beer Garden and Schnitz on July 3.
Hoff moved to hold a hearing on June 1 at 7:36 p.m. for applications concerning the renewal of malt beverage licenses. Guthmiller seconded; all ayes. (Malt Beverage Renewals-Retail (on/off sale) Klaudt Service and Schnitz; Package (off sale) Beer Garden and Country Pride.)
RESOLUTION 5-4-09 #5
Alderman Jerome Hoff introduced the following resolution and moved for its adoption.
LET IT BE RESOLVED that the City of Menno, South Dakota shall charge the maximum fee allowed by South Dakota law for malt beverage licenses.
Alderman Jerome Kotalik seconded the motion.
Upon a unanimous vote the resolution was declared adopted.

License fees for malt beverage licenses effective 7-1-2009 will be: on/off sale malt beverage license (RB) $300/fiscal year and off sale malt beverage license (PB) $200/fiscal year.
Mehlhaf moved to allow the Menno Baseball Association to sponsor a fireworks display on July 4. Simonsen seconded; all ayes.
Mehlhaf moved to adopt the following resolution. Fischer seconded; all ayes.

Employer Election To Adopt
Automatic Enrollment Provisions
For the SDRS Supplemental Retirement Plan
Whereas, SDCL 3-13-56 offers SDRS participating employer units the opportunity to choose to add automatic enrollment provisions for the unit’s employees that are hired on or after the effective date of July 1, 2009, OR that are hired on or after the date of this election, whichever may be later, to the SDRS Supplemental Retirement Plan;
Whereas, the City of Menno understands and agrees to the following points:
Special Rule for Automatic Enrollees: if the employee elects not to participate in the plan within 90 days after his or her first pay date and gives notice of that election to the plan in a manner prescribed by the SDRS Board of Trustees, the deferred compensation amount and the associated gains or losses, less federal income tax withholding, shall be refunded to the automatic enrollee within 30 days of receipt of the final contribution.
Now, Therefore, Be It Resolved, that the City of Menno shall elect to add the automatic enrollment provisions as provided under SDCL 3-13, Deferred Compensation Plan for Public Employees, and agrees to the terms and conditions as set forth by SDRS, with an effective date of July 1, 2009.

Fischer moved to extend the hours at the restricted use site on Wednesdays to 8 p.m. Guthmiller seconded; all ayes.
Mayor Tolzin said sweeping the highway through Scotland is no longer an issue as they will be purchasing their own sweeper.
Hoff moved to invite Eric Ambroson from District III to the June 1 council meeting to discuss water and sewer rates. Simonsen seconded; all ayes.
Kotalik moved to charge cost plus 15% for supplies for water taps effective immediately. Hoff seconded; all ayes.
Mehlhaf moved to place an ad in the paper informing property owners of Chapter 40 of the city ordinances which states they must keep their property properly mown and sprayed for weeds. If the property owner fails to do this, the city will mow and/or spray and assess the cost against the property. An ad is to be included reminding people they are in violation of Chapter 29-6 (G) if they are not emptying their sump pumps outside. A violation of this section subjects a person to a fine of up to $200 for each day the violation continues. Fischer seconded; all ayes.
Hoff moved to pay expenses for Hento to attend workshops in Sioux Falls on May 5 and 14. Guthmiller seconded; all ayes.
The SD DENR announced that the City of Menno public water system and the system’s certified operators, Fred Sayler and Roger Heckenlaible, have been awarded a Drinking Water Certificate of Achievement Award. The award is for outstanding water system operations and environmental compliance with state drinking water standards for the past year.
Since the area on the west side of what used to be the Pit Stop is a platted city street, parking a semi there will not be allowed.
For Your Information: The mayor read through the ordinances for Abandoned Vehicles and Nuisances. Discussion was had at length concerning a clean up letter that was sent. No further action was taken.
The council received a thank you stating how much Stel Nusz appreciated “clean up” day.
The April MADC packet and SEFP report were included in the council packets.
