MENNO, SOUTH DAKOTA

Council President Darrell Mehlhaf called the city council to order at 7:30 p.m. on November 2, 2009 in the council room at city hall. Roll call - present: Jerry Fischer, Jerome Hoff, Jerome Kotalik, Darrell Mehlhaf and Scott Simonsen; absent Galen Guthmiller (entered at 7:43 p.m.). Finance Officer Peggy Thranum, Superintendent Fred Sayler, Erik Kaufman and Aaron Matthaei were also present.

 

Hoff moved to approve the agenda. Simonsen seconded; all ayes.

 

REGULAR MEETING ITEMS: Hoff moved to approve the minutes of the October 5 regular meeting and October 22 special meeting. Fischer seconded; all ayes.

 

Fischer moved to approve the October finance report. Kotalik seconded; all ayes.

Fischer moved to support the Experience Works program with a $500 contribution. Simonsen seconded. Roll call-all ayes; Guthmiller absent.

 

SCHEDULED BUSINESS: Hoff moved to table discussion on air conditioning the gym until a rep from the school showed up or the December meeting if no representative from the school was present at the meeting. Kotalik seconded; all ayes.

 

7:43 p.m. Councilman Galen Guthmiller entered the meeting.

 

OLD BUSINESS: Nothing was added to the “To Do List”.

 

No action was taken on the truck route variance. The trailer in question is no longer there.

 

The purpose of putting figures together for a maintenance shop was to have paper work in line to take advantage of any stimulus or grant money that may become available. No action was taken.

 

NEW BUSINESS: Hoff moved to allow Mehlhaf to handle mayoral duties as president of the council. Kotalik seconded; Roll call-all ayes.

 

Guthmiller moved to set December 7 at 7:33 p.m. as the date and time to hold a hearing on the applications for renewal of the following liquor licenses:

  1. Renewal - Package (Off-Sale) Liquor – Thomas R. Fischer, d.b.a. The Schnitz, N. 24’ of Lot 3, Block 2 & S 27’ of Lot 2, Block 2, Original Plat, City of Menno.
  2. Renewal - Retail (On-Sale) Liquor with Sunday Privilege – Thomas R. Fischer, d.b.a. The Schnitz, N. 24’ of Lot 3, Block 2 & S 27’ of Lot 2, Block 2, Original Plat, City of Menno.
  3. Renewal - Package (Off-Sale) Liquor – Ruth Mettler, d.b.a., The Beer Garden, Lots 9-10, Block 2, Original Plat, City of Menno.

Fischer moved to approve the 2nd reading of Ordinance #2009-4, an ordinance that supplements the Pool and Parks Departments of the General Fund; Simonsen seconded. Upon roll call vote, Fischer, Guthmiller, Hoff, Kotalik, Mehlhaf and Simonsen voting aye; none voting nay. Motion passed.

 

The truck ordinance is being amended to correct an error in gross vehicle weight; it should be 26,000 pounds, not 6000. Kotalik moved to approve the 1st reading of the Amended Truck Ordinance #2009-5. Guthmiller seconded; roll call-all ayes.

 

Fischer moved to approve the following appraisals for the John Deere 420 U tractor and Detroit Harvester Mower: Calvin Hagge – tractor $3100-$3600/mower $400-$500, Gerald Handel – tractor $2900-$3400/mower $350-$450 and Gerald Nusz – tractor $3250/mower $350-$400. Hoff seconded. Roll call-all ayes.

 

Fischer moved to table a decision to advertise the tractor/mower for sale until the January 2010 meeting. Simonsen seconded; roll call-all ayes. Mehlhaf is to contact Wieman Action about listing the tractor/mower at their machinery sale next spring.

 

Hoff moved to approve using Mehlhaf and Thranum as authorized officials and Marsha Schelske as a delegated official on the forms for the revalidation process for Noridian Administrative Services. Fischer seconded; roll call-all ayes. Medicare supplies must resubmit and recertify the accuracy of their enrollment information every five years to maintain Medicare billing privileges. 

 

Mehlhaf appointed Jerome Hoff as a council representative to the MADC housing committee.

 

Mehlhaf appointed Jerry Fischer to the gym committee.

 

Guthmiller moved to approve the Auditorium Agreement between the City and School. Hoff seconded; roll call-all ayes.

 

For Your Information: The October MADC packets and SEFP report were included in the council packets.

 

An invitation was received to a community supper honoring our Veterans at the Vermillion Armory November 4, 2009 from 5-8.

 

The council is invited to an in-depth discussion on the impact that pending Federal Climate Change and Energy Legislation could have on South Dakota business. The discussion will be held at the Sioux Falls Convention Center November 20 beginning at 11:30 a.m.

 

Fischer stated the picnic tables that are missing from the pool are at the Power Show site.

 

Thranum placed a call to Arens, who was unavoidably detained at another council meeting. He stated the smoke testing that is to be done as part of the engineering study for the Small Community Planning grant will be scheduled for December. If the weather doesn’t cooperate, it will have to be done in the spring. He has not heard anything back from the Wastewater Study, but may move ahead with surveying the manholes. Drainage on Railway Street was discussed; Arens will look into an option of draining the water to the west.

 

Kotalik mentioned Bender Sewer from Mitchell would like to be considered when we clean our sewer lines.

 

Sayler is to check into the cost of lining the sewers.

 

Guthmiller moved to adjourn at 8:55 p.m. until Monday, December 7, 2009 at 7:30 p.m. Kotalik seconded; all ayes.
