MINUTES OF CITY COUNCIL PROCEEDINGS
MENNO, SOUTH DAKOTA
Mayor Darrell Mehlhaf called the city council to order at 7:30 p.m. on May 3, 2010 in the finance office at city hall. Roll Call: Darrell Mehlhaf, Ronald Diede, Jerry Fischer, Galen Guthmiller, Jerome Hoff, Jerome Kotalik and Scott Simonsen; quorum present. Finance Officer Peggy Thranum, Superintendent Roger Heckenlaible, Mark Heirigs, John Huber, Aaron Matthaei and Erik Kaufman were also present.
Hoff moved to approve the agenda with the following changes: Delete – Lifeguard Workshop; Add – Unlicensed Vehicles and Mark Heirigs. Fischer seconded; all ayes.
REGULAR MEETING ITEMS: Hoff moved to approve the minutes of the April 5 regular meeting and April 15 meeting to canvass votes. Diede seconded; all ayes.
Kotalik moved to approve the April finance report. Simonsen seconded; all ayes.

Hoff moved to hold the funds for Junior Legion Baseball as there is no team at this time. Guthmiller seconded; roll call, all ayes.
Fischer moved to release $3000 to the Athletic Club. The other $1000 may be released at a later date if there will be a swim team. Kotalik seconded; roll call, all ayes.
SCHEDULED BUSINESS: Sharon Guthmiller and Karen Dolan were not present.
Fire Chief John Huber asked if the city would consider making a donation to the fire department toward the purchase of a new “Jaws of Life”. Diede moved to table this topic to the June council meeting. Guthmiller seconded; all ayes. Huber left the meeting at 7:50 p.m.
Glenn Kirschenman was not present.
OLD BUSINESS: “To Do List” Nothing added at this time.
Mark Swanson from SWS, Inc. stated they would not be providing service from the antennae on our water tower until some time next year.
Kotalik moved to adjourn at 7:49 p.m. Hoff seconded; all ayes.
Mayor Darrell J. Mehlhaf and Councilmen Jerry Fischer, Ronald Diede, Galen Guthmiller and Jerome Hoff took the oath of office.
The meeting reconvened at 7:52 p.m.
NEW BUSINESS: Guthmiller moved to elect Jerome Hoff as council president. Fischer seconded; all ayes.
Fischer moved to elect Galen Guthmiller as council vice-president. Diede seconded; all ayes.
Hoff moved to approve the following resolution of service. Guthmiller seconded; all ayes.
“Let it be resolved that the City of Menno extends a sincere “Thank You” to Larry Tolzin for his dedicated service to the city and citizens of Menno, South Dakota; first as Ward II Councilman for 5 years and then as Mayor for 7 years.”

Mark Heirigs asked if maintenance would cut mulberry trees out of the north and west fence lines at the cemetery and to either build a bunker or move the pile of dirt at the cemetery as it is hard to mow around. This will be done. The mayor thanked Heirigs for the good job they do mowing and mentioned the numerous remarks heard about how good our cemetery always looks.
Kotalik moved to approve allowing Thranum to attend SEAFOG meetings when she is able. Fischer seconded; all ayes.
Diede moved to approve Thranum attending the final session of the Municipal Clerk Program in Vermillion July 12-16. Guthmiller seconded; all ayes.
Simonsen moved to hold the July council meeting on Friday, July 2 at 5:45 p.m. as July 5 is a holiday. Diede seconded; all ayes.
Hoff moved to hold a hearing on June 7 at 7:35 p.m. for applications concerning the renewal of malt beverage licenses. Fischer seconded; all ayes.
Fischer moved to hold a hearing on June 7 at 7:35 p.m. concerning a permit allowing consumption of alcohol in a public place. Hoff seconded; all ayes. The permit is for an alley dance between the Beer Garden and Schnitz on July 2.
Hoff moved to hold a hearing on June 7 at 7:35 p.m. for a Temporary Malt Beverage Permit for the Menno Alumni on July 4 at the city-school gym. Guthmiller seconded; all present voting aye.
Simonsen moved to allow the Menno Baseball Association to sponsor a fireworks display July 3. Diede seconded; all ayes. (Rain date – July 4.)
Fischer moved not to carry terrorism insurance. Simonsen seconded; all ayes.
Pool hours are expected to remain the same except Wednesday evening will be “Adult Night”. Admittance to adult night will be allowed on the family pass. Any changes to regular pool hours will be at the discretion of the pool manager and will be posted at the pool.
The tentative date for opening the pool will be Memorial Day weekend and the tentative closing date will be August 20.
Diede moved to find the least expensive surveyor and pay 50% of the cost to survey the property line that borders the city lot at 265 W Main Street. Hoff seconded; all ayes.
Tree trimming at the city park was discussed. A motion was made at the October 5, 2009 council meeting to leave to the discretion of the Parks Committee as to what trees need to be trimmed or cut down at the city park and who will do the work. The work needs to be completed before July 4.
Simonsen moved to table any decision concerning a part-time maintenance worker until the June meeting. Fischer seconded; all ayes.
Hoff moved to have the picnic shelter at the Bi-Centennial Park removed and replaced with a wooden picnic table. Guthmiller seconded; all ayes. The wood in the present shelter is rotten causing it to become a liability. The poles supporting the bench on the north side broke off and there are holes in the roof.
Fischer moved to have the arch repaired at the cemetery; the cost will be close to $1000. Diede seconded; all ayes.
Guthmiller moved to purchase a new door closure for the main entrance of city hall; maintenance will install it. Hoff seconded; all ayes.
Kotalik moved to pay expenses for those that need to attend the meeting in Pierre June 24 concerning funding for our US Highway 18 water and sewer projects. Hoff seconded; all ayes.
SDRS training is the same day as the meeting in Pierre, so the finance officer will not be attending.
The SD Department of Environment and Natural Resources awarded the City of Menno public water system and the system’s certified operators the Drinking Water Certificate of Achievement Award. The award is for outstanding water system operations and environmental compliance with state drinking water standards for the past year. Congratulations to our certified operators, Fred Sayler and Roger Heckenlaible.
The council has received complaints concerning unlicensed vehicles. We have an ordinance in place addressing this issue. Thranum is to make copies of the ordinance to give Hento so when he finds an unlicensed vehicle he may give a copy to the car owner thereby notifying them they need to correct the issue within 14 days (on advice of city attorney).
The south two blocks of Fifth Street may need to be chip sealed. The street north of the museum is in disrepair – will see if we may apply for a Community Access Grant for this street.
Classic Collision wishes to have a driveway on the northwest corner of their building, which would cross the drainage ditch to the west of their property. The mayor spoke with Ron Peterson, area DOT engineer for this area and he stated the city has responsibility for this ditch. Peterson suggested a new 24’ culvert be installed in the driveway. All costs for this driveway will be at Classic Collision’s expense. They will also work on drainage between them and the Dairy Bar to route the water to the north.
Larry Tolzin entered the meeting at 9 p.m. Mehlhaf presented him with the resolution thanking him for his service to the city.
Maintenance is to have the tractor and mower to Wieman’s in the next couple weeks.
For Your Information: The museum has been given permission to use the city garage for the rummage sale May 7-8 if they clean it up.
The April MADC packet and SEFP report were distributed to the council.
